O FEMININO NO SISTEMA PRISIONAL: O APRISIONAMENTO SIMBÓLICO DO FEMININO NAS MULHERES QUE CUMPREM PENA DE PRIVAÇÃO DE LIBERDADE

RESUMO:

O presente estudo visou problematizar os efeitos das lógicas prisionais em um duplo aprisionamento do feminino no interior desse sistema. Tais lógicas incidem sobre a mulher que cumpre pena de privação de liberdade, marcada por uma instituição masculina e construída sobre as bases do patriarcado. Relacionando os conceitos de Goffman e Foucault com o contexto no qual as lógicas prisionais implícitas se constituíram, discutiu-se as produções de instituições totais na formação dos corpos em sociedade, assim como nas normatizações que se expressam para além das instituições. Também foram levantados aspectos sobre como ideais patriarcais atuaram na construção de um ideal de gênero que não levou em conta a possibilidade da mulher ocupar um lugar ativo na quebra de normas e leis, ou seja, o seu não lugar na prisão. Ao entrar no sistema prisional a mulher passa a viver sob lógicas de uma instituição que em momento algum a considerou enquanto sujeito, multiplicando a invisibilidade e negligência com relação ao feminino. Assim, opera neste contexto o aumento de sua fragilidade diante das lógicas ali existentes. Em decorrência disto, observa-se um movimento de “aprisionar” este feminino em busca da própria sobrevivência neste contexto, adota-se então um comportamento condizente com as lógicas ali vigentes que vão em contrapartida ao feminino que foi construído e reafirmado ao longo de suas vidas.

THE FEMININE IN THE PRISION SYSTEM: THE SYMBOLIC IMPRISONMENT OF THE FEMININE IN WOMEN FULFILLING THE PENALTY OF DEPRIVATION OF FREEDOM

ABSTRACT:

The present study aimed to problematize the effects of prison logics in double imprisonment of women within this system. Such logics happen upon woman serving a sentence of deprivation of liberty, marked by a male institution and built on the basis of patriarchy. Relating the concepts of Goffman and Foucault with the context in which the implicit prison logics were constituted, this article discusses the productions of total institutions in the formation citizens in society, as well as in the regulations that are expressed beyond the institutions. Also were raised aspects about how patriarchal ideals acted in the construction of a gender ideal that did not take in consideration the possibility of women occupy an active place breaking norms and laws, which means if its or not their place in prison. When entering the prison system the woman starts to live under the logic of an institution that at no time considered her as a subject, multiplying the invisibility and neglecting her regarding to feminism. In this manner, it operates in this context increasing their fragility in the eyes of the existing logics. As a consequence of this, a movement is observed to "imprison" this feminism looking for its survival in this context, this way they adopt a behavior consistent with the logic that exists there that goes against the feminism built and reaffirmed throughout their lives.
